Nothing in these Terms and Conditions excludes or restricts mandatory consumer rights under applicable European Union law or Polish consumer protection law.

1. USE OF THE ONLINE STORE

Our online store may be used by individuals who have the legal capacity to enter into contracts under applicable law.

When placing an order, you must provide accurate, complete, and up-to-date information necessary to process and deliver your order.

You must not use our website:

  • For any unlawful purpose

  • To attempt unauthorized access to our systems

  • To distribute malicious software

  • To engage in fraudulent activities

  • To violate the rights of third parties

  • To submit false, inaccurate, or misleading information

We reserve the right to restrict access to our online store where there is reasonable evidence of misuse, fraud, unlawful activity, or a material violation of these Terms and Conditions.

Any restriction will be applied in accordance with applicable law and will not unlawfully interfere with consumer rights.

2. PRODUCT INFORMATION

We make reasonable efforts to provide accurate, current, and understandable information about the products offered in our online store.

Product pages may include information about:

  • Product names

  • Features and functions

  • Available variants

  • Prices

  • Availability

  • Delivery information

Product photographs and displayed colors may vary slightly depending on the device, screen, lighting, or display settings used.

Such technical differences do not remove our obligation to supply goods that conform to the product description and the sales contract.

We do not knowingly publish false or misleading information about product features, availability, origin, or prices.

If we discover a material error in product information, we will make reasonable efforts to correct it promptly.

3. PRICES

The price displayed for a product is the price applicable at the time the order is placed, subject to any clearly disclosed conditions and applicable law.

Before completing an order, customers will be shown the total order price, including applicable taxes and any mandatory additional charges.

Standard shipping to Poland is free of charge.

Standard shipping cost: PLN 0.

We will not add undisclosed mandatory fees to an order after the customer has confirmed the purchase.

Any applicable taxes, duties, or other legally required charges will be handled in accordance with applicable law and the information presented to the customer before the order is completed.

If a price or product listing contains an obvious error, we will handle the situation in accordance with Section 17 and applicable law.

4. ORDERS

By submitting an order, the customer confirms that the information provided is accurate to the best of their knowledge.

An order confirmation may be sent automatically to the email address provided during checkout.

An order confirmation acknowledging receipt of an order does not necessarily mean that the order has been dispatched.

We may need to decline or cancel an order in circumstances such as:

  • An obvious pricing or product information error

  • Product unavailability

  • Suspected fraud or unauthorized use of payment information

  • A technical error affecting the order

  • An inability to fulfill the order

Any refusal or cancellation will be handled in accordance with applicable law and any contractual obligations already established.

If payment has already been collected for an order that is validly cancelled, the applicable amount will be refunded in accordance with the relevant payment method and applicable law.

We will notify the customer of a cancellation or material change using the contact details provided with the order.

5. PAYMENT

The payment methods actually available for an order will be displayed during checkout.

Customers must provide accurate payment information and must be authorized to use the selected payment method.

By selecting a payment method, you confirm that you are authorized to use it.

We will not charge payment fees that have not been clearly disclosed before the order is completed.

Payments may be processed by third-party payment service providers. Such providers may apply their own terms and privacy policies.

The availability of a particular payment method is determined by the options displayed during checkout.

6. ORDER PROCESSING

Order processing time: 1–3 business days.

We generally prepare orders for dispatch within 1–3 business days after the order has been successfully placed.

Business days generally mean Monday through Friday, excluding applicable public holidays.

Exceptional circumstances, including technical problems, operational disruptions, or other events beyond our reasonable control, may affect the processing time.

If a significant issue affects an order, we will make reasonable efforts to inform the customer using the contact information provided.

The stated processing time is an estimate of the time required to prepare an order for dispatch and is separate from the shipping transit time.

7. SHIPPING TO POLAND

Our standard shipping terms for orders delivered to Poland are:

  • Order processing time: 1–3 business days

  • Estimated shipping transit time: 3–7 business days

  • Estimated total delivery time: 4–10 business days

  • Standard shipping: Free of charge

  • Standard shipping cost: PLN 0

Shipping transit time begins when the order has been handed over to the shipping carrier.

The estimated total delivery time is based on the stated processing and transit periods. Actual delivery times may vary because of carrier operations, public holidays, adverse weather, or other circumstances beyond our reasonable control.

We will make reasonable efforts to deliver orders within the estimated period communicated on our website.

Detailed information is available in our Shipping Policy.

Nothing in this section limits any mandatory delivery obligations or statutory consumer rights.

8. RECEIPT OF GOODS AND RISK OF LOSS

For consumer purchases, the risk of accidental loss of or damage to goods does not generally pass to the consumer merely because the goods have been handed over to the carrier.

Unless a statutory exception applies, the risk generally passes when the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods.

We recommend checking the shipment and its contents after delivery.

If the parcel or product arrives damaged, please contact us as soon as reasonably possible at:

Email: cdsyhgb@gmail.com

Any reporting procedure does not restrict statutory consumer rights.

9. 30-DAY VOLUNTARY RETURN POLICY

We offer a 30-day voluntary return period for eligible products.

The period begins on the date the customer receives the last item in the order where multiple items are delivered separately.

If the final day of the voluntary return period falls on a weekend or public holiday, the period will extend to the next business day where applicable.

To request a return, please contact us at:

Email: cdsyhgb@gmail.com

For ordinary voluntary returns, the customer is responsible for the direct return shipping costs, where permitted by applicable law.

Restocking fee: 0%.

We do not charge a separate restocking fee for returned products.

Detailed conditions, return instructions, and refund procedures are provided in our Return and Refund Policy.

This voluntary return policy is separate from the statutory right of withdrawal and statutory remedies for defective goods.

10. STATUTORY 14-DAY RIGHT OF WITHDRAWAL

Consumers in Poland and other European Union Member States generally have a statutory right to withdraw from eligible distance contracts within 14 days without giving a reason, subject to applicable legal exceptions.

For purchases of goods, the withdrawal period generally begins when the consumer, or a third party designated by the consumer other than the carrier, receives the goods.

For orders containing multiple items delivered separately, the period generally begins when the last item is received.

To exercise the right of withdrawal, please send us an unequivocal statement of your decision before the withdrawal period expires.

Email: cdsyhgb@gmail.com

You do not need to provide a reason for exercising this right.

Following withdrawal, the goods must generally be returned within 14 days after notifying us of the decision to withdraw, subject to applicable law.

For ordinary withdrawal, the customer is generally responsible for direct return shipping costs if this responsibility was properly disclosed and applicable law permits it.

Where required by law, we will refund the applicable payments, including the cost of the least expensive standard delivery option offered, if applicable.

Our voluntary 30-day return period does not replace, restrict, or reduce the statutory 14-day right of withdrawal.

Certain products or circumstances may be excluded from this right under applicable law.

11. REFUNDS

After receiving and assessing returned goods, we will inform the customer of the outcome of the return process where applicable.

For approved voluntary returns, our general processing target is to issue the refund within 10 business days after approval.

This is an internal processing target and does not extend any mandatory statutory refund deadline.

For statutory withdrawals, refunds will be issued within the deadlines required by applicable consumer protection law.

Refunds will generally be made using the original payment method unless another method is agreed with the customer and permitted by law. We will not charge a fee for processing a refund.

Where permitted by applicable law, we may withhold reimbursement until we receive the returned goods or the customer provides evidence that the goods have been sent back, whichever occurs first.

If the customer selected a more expensive delivery method than the least expensive standard delivery option offered, we may not be required to refund the additional delivery cost, as permitted by law.

Our standard shipping is free of charge.

The time required for a refund to appear in the customer's account may depend on the bank or payment service provider.

For refund inquiries, please contact cdsyhgb@gmail.com and include your order number.

12. DAMAGED, DEFECTIVE, OR INCORRECTLY DELIVERED GOODS

If you receive:

  • A damaged product

  • A defective product

  • An incorrect product

  • A product that materially differs from the sales contract

please contact us at:

Email: cdsyhgb@gmail.com

Please provide your order number and a description of the issue. We may also request photographs or other relevant information to help assess the case.

After reviewing the circumstances, we will provide an appropriate solution in accordance with applicable law.

Depending on the circumstances, the available remedy may include repair, replacement, delivery of missing items, a price reduction, a refund, or another remedy required by law.

Where a claim is valid, the customer will not be required to bear costs that the seller is legally obligated to pay.

This procedure does not restrict statutory consumer rights concerning non-conforming goods.

13. STATUTORY LIABILITY FOR DEFECTIVE OR NON-CONFORMING GOODS

Consumers retain their statutory rights relating to defective goods and goods that do not conform to the sales contract.

These rights exist independently of our voluntary 30-day return policy.

Depending on the circumstances and applicable law, consumers may be entitled to request:

  • Repair

  • Replacement

  • An appropriate price reduction

  • Termination of the sales contract and a refund, where the legal requirements are satisfied

The availability of a particular remedy depends on the nature of the non-conformity and the applicable legal requirements.

Nothing in these Terms and Conditions excludes or restricts any mandatory statutory consumer rights.

14. EXCHANGES

We do not offer direct product exchanges as a standard service.

If you want a different product or variant, the usual procedure is to:

  1. Request a return of the original product.

  2. Complete the applicable return process.

  3. Place a new, separate order for the desired product.

This procedure does not affect statutory remedies for defective, damaged, or incorrectly delivered goods.

15. ORDER CANCELLATIONS

If you wish to cancel an order, please contact us as soon as possible at:

Email: cdsyhgb@gmail.com

Because our order processing period is 1–3 business days, an order may already be undergoing preparation or may have been dispatched when we receive your request.

We cannot guarantee that an order can be stopped after processing or dispatch has begun.

If an order can no longer be cancelled before dispatch, consumers may still exercise any applicable statutory withdrawal rights or use the return procedure described in our policies.

Any cancellation, refund, or related charges will be handled in accordance with applicable law.

16. PRODUCT AVAILABILITY

We make reasonable efforts to display current product availability.

In exceptional circumstances, a product may become unavailable after an order has been placed.

If we cannot fulfill an order because the product is unavailable, we will inform the customer and refund any payment already collected for the unfulfilled order, as required by applicable law.

We will not knowingly accept orders for products that we know are unavailable without appropriately informing customers.

17. ERRORS IN PRICES OR PRODUCT DESCRIPTIONS

Although we make reasonable efforts to maintain accurate information, administrative or technical errors may occasionally occur.

If we identify an obvious error in a product price, availability, or description before the order is completed, we may contact the customer to clarify the situation.

If an error is discovered after an order has been placed, we will address it in accordance with applicable law and any contractual obligations that have already arisen.

We will not unilaterally charge a higher price than the price agreed to by the customer when placing the order.

Where an order cannot lawfully be fulfilled as agreed, we will inform the customer and arrange an appropriate solution.

18. INTELLECTUAL PROPERTY

The content of our online store, including text, graphics, logos, photographs, design elements, and other materials, may be protected by copyright, trademarks, or other intellectual property rights.

Unless authorized by the relevant rights holder or permitted by law, website content may not be copied, distributed, reproduced, or commercially exploited without permission.

Third-party rights, including those of Shopify and the respective owners of trademarks and other intellectual property, remain unaffected.

Nothing in these Terms and Conditions grants customers ownership of our website content or third-party intellectual property.

19. THIRD-PARTY SERVICES

Our online store may use third-party services, including:

  • Payment service providers

  • Shipping and delivery companies

  • Analytics tools

  • Shopify

  • Other technical and operational service providers

The use of third-party services may also be subject to the providers' own terms and privacy policies.

Third-party services may support the operation of our store, payment processing, order fulfillment, delivery, or customer service.

Cx & tekniq ApS remains the seller responsible for the sales contract and the obligations that applicable law assigns to the seller.

The use of a third-party service does not remove any statutory consumer rights.

20. SHOPIFY

The carvexis.shop online store uses the Shopify platform.

Shopify provides the technical infrastructure that enables us to operate our online store and offer products to customers.

The sales contract for products purchased through carvexis.shop is between the customer and Cx & tekniq ApS, not Shopify.

Questions relating to orders, products, shipping, returns, refunds, or the seller's obligations should therefore be directed to us.

Shopify's own services and any related data processing may be governed by Shopify's applicable terms and privacy policies.

21. PERSONAL DATA PROTECTION

We process personal data in accordance with our Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (GDPR) where applicable.

Personal data may include information necessary to process orders, communicate with customers, arrange delivery, handle returns and refunds, prevent fraud, and comply with legal obligations.

Where necessary for these purposes, we may share relevant information with service providers such as Shopify, payment service providers, shipping carriers, and other authorized processors.

We process personal data only on an appropriate legal basis and in accordance with applicable data protection requirements.

For more information about the data we collect, how we use it, and the rights available to customers, please consult our Privacy Policy.

22. LIABILITY

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by mandatory law.

We are not responsible for delays or failures caused by circumstances beyond our reasonable control to the extent that applicable law permits such a limitation.

This section does not exclude liability for obligations that cannot legally be excluded or restricted.

Customers retain all mandatory statutory rights, including rights relating to delivery, refunds, defective goods, and non-conformity with the sales contract.

23. FORCE MAJEURE AND EXCEPTIONAL CIRCUMSTANCES

Circumstances beyond our reasonable control may occasionally affect the operation of our store or the fulfillment of orders.

Such circumstances may include:

  • Serious infrastructure failures

  • Natural disasters

  • Major transportation disruptions

  • Actions of public authorities

  • Widespread technical failures

  • Other exceptional events beyond our reasonable control

If such circumstances affect an order, we will make reasonable efforts to inform the customer and resolve the issue within an appropriate period.

This section does not remove mandatory consumer rights or excuse obligations where applicable law does not permit such an exemption.

24. COMPLAINTS AND CUSTOMER SUPPORT

If you experience a problem with an order or our services, we encourage you to contact us directly in the first instance.

Email: cdsyhgb@gmail.com

Please include your order number and a clear description of the problem.

We will review your inquiry and make reasonable efforts to resolve the matter fairly and transparently.

Customers retain any statutory rights to submit complaints to competent consumer protection authorities or seek other remedies available under applicable law.

25. OUT-OF-COURT CONSUMER DISPUTE RESOLUTION

If a dispute arises between the customer and the seller in connection with a sales contract and cannot be resolved directly, the consumer may be entitled to use an appropriate out-of-court dispute resolution procedure.

For consumers in Poland, information about available consumer dispute resolution mechanisms may be obtained from the relevant Polish consumer protection authorities, including the Office of Competition and Consumer Protection (UOKi
